This Privacy Policy (the “Policy”) describes how GCI Asset Management, HK Limited (“GCI”) collects, uses and shares the information you provide to us and the information we collect in the course of operating our business and our website.

Further, in this policy “investor” shall mean current professional investors (as defined under the Securities and Futures Ordinance Cap 571 of the laws of New York) of GCI funds and accounts, together with potential professional investors for such products.

The information that we collect and where we get it from “Personal information” is any information that can be used to identify you or that we can link to you and which we have in our possession or control – i.e., data we collect from you, the way in which it is collected and the purposes for which it is collected and used.   • Signing up for investor services: when you sign up for newsletters, calls, events or obtain other investor services from us or when you contact us with queries or respond to our communications, the personal information you provide may include your full name, job title, telephone number, email address and content, date and time of your correspondence and information about your firm or your business.
  • In connection with our provision of investor services: if you are an investor in a GCI fund or account, you will provide us with personal information when you or the firm you represent becomes an investor. If you are not an investor, we may collect or receive your personal information because you are involved in a fund or related marketing initiatives.

Information we otherwise collect about you We will also collect information about when you use our services or when we otherwise interact or correspond with you. We use various technologies to collect and store information when you visit our website.   • Third parties relevant to the services that we provide. This may include, but is not limited to, fund administrators and custodians, other professional service providers, counterparties to litigation, regulators, authorities and governmental institutions.

Opt-Out Provisions It is not a policy of GCI to share non-public personal and financial information with affiliated or unaffiliated third parties except under the circumstances noted above. Since sharing under the circumstances noted above is necessary to service customer accounts or is mandated by law, there are no allowances made for investors to opt out.

Protecting your data outside New York The data that we collect from you may be held within, or transferred to, third-party data processors in countries that are outside New York, such as Japan or otherwise within Asia. If we do this, we have procedures in place to ensure your data receives the same protection as if it were being processed inside New York. For example, our contracts with third parties stipulate the standards they must follow at all times.   • Objecting to, and requesting that we restrict, our processing of your personal information in certain circumstances. Again, there may be circumstances where you object to, or ask us to restrict, our processing of your personal information but we are legally entitled to refuse that request.

Confidentiality and Non-compete

By accessing the Site (including any password-protected are of the Site), you may receive non-public confidential information (the “Confidential Information“) relating to GCI, GCI funds or investment vehicles managed or advised by GCI (“GCI Funds“) and / or investments made, or to be made, by them (the “Investment“). By accessing the Site (including any password protected areas of the Site), you expressly agree:

  1. to protect the Confidential Information and not disclose it to any third party (other than your director, officers and employees);
  2. not to use the Confidential Information for any purpose other than to evaluate a potential investment in a GCI Fund; and
  3. in respect of any Investment, not to directly or indirectly approach, negotiate with, or solicit any potential Investment (or any other investment or financing) from a Restricted Stakeholder for a period of 12 months following final receipt of any Confidential Information in relation to that Investment. For these purposes “Restricted Stakeholder” means, in relation to an Investment, any relevant buyer, seller, stakeholder, investor, shareholder, target, obligor or issuer (and / or their affiliates) under that Investment who is named or described in the Confidential Information.

Internet Communication

Messages sent over the Internet cannot be guaranteed to be completely secure. GCI will not be responsible for any damages incurred by you as a result of any delay, loss diversion, alteration or corruption of any message either sent to or received from GCI at your request, over the Internet. GCI is not responsible in any manner for direct, indirect, special or consequential damages arising out of the use of this Site.
